Count me in: I'm close to the 6 year mark. Applied in 07/2002 and received an approval on 05/2008. My labor petition was stuck for 4.5 yrs. I did petition through the local Senator about my pending labor only to get a standard note from the USCIS about the BEC process.
We need to get some...
I did catch up with my lawyer about this. The fact that I had my 485 pending for over a year with flexibility to change employers by invoking AC21 and more importantly nothing baked into the law once you have your GC, she adviced it was ok to move along after at least a month.
If close to 7...
Thanks for your input.
Yes, the approval came over a year after my 485 was filed. My labor petition was stuck for 4.5 yrs. I'm hoping the delayed processing timelines with my case is justification enough.
I have been with the same employer for 7 yrs now. My GC process took close to 6 yrs and I would REALLY like to move on. Its getting close to a month now that I have my GC in hand and offers are starting to trickle in - mostly for similar kind of work.
In reading through the posts, the...

I need your expertise to help clarify this for me further. How does out of status equate to legal stay. Can you have your I -485 pending and not be on any status i.e. H1 or employed through EAD?
Folks:
I just got an RFE on my wife's 485 application (my application is pending too). I wanted to find out:
1. Does the USCIS mail a copy of the RFE to the petitioner as well. My lawyer's address has changed and this apparently has been causing some issues with them receiving mail from...
Thanks for your response Mmed.
I guess as long as one has a job on the day the GC is approved your still in status given that the I-485 is pending regardless of what happens in the interim.
Folks:
I'm looking for some guidance as I'm contemplating switiching jobs and ideally would like to do so by going through an H1 transfer (I'm on my 7th year extension already). Let's say I have to make the swtich based on my approved EAD as the prospective employer won't file for a transfer...
I'm at a stage where I believe I qualify for the AC 21 portability: I-140 is approved (EB2), EAD is approved and 180 days have passed since my 485 has been filed. That said I wanted to get clarity on a couple of questions:
1. Do I qualify for the AC 21 portability clause given my priority...
I don't think they sent my wife's card out to begin with. We never changed our address. I got my EAD in 2 days after they said they had sent the approval notice. My wife didn't get her card although her approval notice, at least so they claim was sent on the same day. It appears that the first...
Finally got it.
We called customer service after the 30 day waiting period. They assigned us a case number. I had no hopes and was planning on re-applying within a week after raising the service request had we not heard anything. Couple of days after the service request was raised I received a...

In the event of having to file for a replacement EAD, I'm assuming the $340 filing fee is in effect for us? Please let me know if there's any clause out there that specifically will let us file under to old filing fee - especially since we never ever did receive the supposedly mailed EAD.
My...
My wife is in the same boat - check out my thread 'EAD Approval Notices sent but only 1 received' for details.
I was hoping we can go to the local CIS office after the 30 day waiting period in hopes of securing a replacement card, but it doesn't appear to be that straightforward.
Hassan2007,
I'm alright for now on my H1. The issue is my wife needs to have the card in order to apply for her social security, apply for a job, get auto insurance etc. I hope the USCIS will let us go to the local office after the 30 day period and issue the card. But from what I've read it...
