How can you upgrade to PP
I have a RFE on my 140, yet to be replied. Is it possible to upgrade to PP at a later stage. How were you able to upgrade?Pls let me know ASAp.
I think it is TOO late to complain. So far there are 35 complaints of which over 20 have submitted solid evidences. Not sure what made you wait so long.
Yes my company also recd similar RFE for past 3 yrs... seems RFE is becoming the way of life and some more stress. My PD is 2003 so they need 2003, 04 & 05. Good they didn't ask for 2006.
I think best option in this situation is to maintain good relations wiht the old employer. There is no reason he will cancel ur labor bcos this is not going to cost him anything.... one must try not to burn the bridges. Meanwhile if your new perm comes through and 140 approves (premium process)...
Old and New PERM labor
If the old RIR is still pending in backlog and the new PERM comes through (same employer) - does that mean old labor becomes invalid. I am NOT using the PD of old labor and both are EB2.
So manwithnoname - DID you mean to say one who has pending labor at PBEC can file a PERM and then port the PD once the 140 based on the PERM Labor is approved? Or you mean when the 140 thru PBEC labor gets approved?
Also, in that case should the job description of the PERM and old labor...
Is Fifo Being Followed??
I have a feeling murthy.com is not providing clear info - they are still saying PBES is still doing 2001 & 2002 cases and just one case of later date has been approved. WHAT AN IRONY. If they visit this forum they will know the reality...if DOL is following any FIFO or...
thanks! yep I know that rule but it is not mandatory. Only think is I want to avoid a situation of giving address of X state when labor is filed from Y. So it is better I will depend on mt lawyers address... bottomline is when reality will happen -who knows! thanks again for your reply.
Are you supposed to inform about address change to PBEC for LC also? My lawyer never suggested it. Also, in case my LC was originally filed in VA and now I am working at say MA. In that case would it make sense? Pls advise ASAP accordingly I will talk to my lawyer.
140 premium processing
Has this been approved? If not then my feeling is labors will come thru ONLY after this is passed for simple reason - Longer the wait, more will be the rush for 140 and better revenue... I know all this sound wiered but think how much revenue it will generate.

Keep ALL of upto 2002. Technically speaking due date sept'2007 to clear up backlog does not makes sense for people who are in Queue for around 4 yrs just for a labor clearance.
Looks like our case is quite similar. I received 45 day in Dec'05. Now waiting almost after 6 months. I saw very few NJ approvals. That is the worrying part...what the hell is going on.
