Go back to your home country for 4 months. Your attorney should then apply 4 months extension of your H1B (to recapture the period you were out of US). Then, come back and apply for H1B extension for one year as your labor would have been filed a year before expiry of your H1B.

Sounds correct. If you volunteerily change your job within the six months, you're in trouble. If they fire you, it's out of your control; therefore you're doing fine... just get a similar job and take it easy.

Thanks for injecting some positive thoughts here. I didn't really mean to imply that the dates actually could move that far back... I was only trying to make a point.
labor sub has already been banned, so hopefully things will stop getting worse from here.
The trouble was not the lack of applications with early PD's, but the BEC not clearing them soon enough. Many many approvals from BEC's arrived in mid 2007 (a lot of people even missed the Aug 17th deadline, some made by a whisker!) Those apps are now there!

The answer is BEC's! 400,000 labor applications from all categories and periods (before 2005) had been rotting there. They went hyperactive in 2007 and cleared them, and that's when pre-Jan 03 PD's started materilizing... in tens and hundreds of thousands!

You can use AC21 as many times as you like. The job description doesn't have to be too close. If you're in IT, remain in IT, don't start working in a bakery shop and you'll be fine.
I think they have to refile I-140. And it's pointless to move anyway, what if EB3 goes back to Jan 01, 99 next month? PD movement is hardly predictable.
