I believe AILF is working on the new version of FAQ's, due to the expansion of the lawsuit to non-filers...
ORIGINAL NOTE FROM AILA on July Consular Processing - I bet these requests happened from mid-June to end-June...even before USCIS got it's act together - Does that mean all Consular Processing guys are the lucky ones?
I remember, few years ago, that's what most folks would do....Since USCIS...

July 2, 2007, State Department Notice to USCIS Regarding EB Visa Availability
AILA InfoNet Doc. No. 07070663
URGENT URGENT URGENT
TO : CIS Section 245 ADJUDICATIONS
FROM : Immigrant Visa Control
SUBJECT : Authoriirations for Employment CASES...
Yep.....as long as the employer does not revoke I140 - in the first 6 months of I485....one can show as using AC21 - after 6 monhts (even though one used if before)....you should be good
If the employer happes to layoff....during the first 6 monhts of I485...lot of people tend to use this...
All Green Card petitions are filed by employers with the intention to hire the employee after receipt of green card - and to engage in permant employment (via the permanent green card)....
So, green card is for future employment, after getting the green card....
But the law AC21, allows you...
So, Murthy also received approved approvals in July...as also pointed out by www.shusterman.com
But why is Murthy saying - approved in error?
I can understand one reason - that approvals in June on petitions that did not have the PD's current....But, why are they complaing about July? They...
Check out the thread....from MohitFL
Filed I485 on May 31 for spouse. Mine apprvd on June 1. Whats her I485 future?

Check out the thread from MohitFL - one can use "Follow to Join" clause and still apply 485 for wife....even after one's GC approval...
In fact, MothitFL just did that...he filed for I485 for his wife after his approval....I believe the key is that one should be married before the I485...
In fact, that's what USCIS - lawyers were looking at USCIS and they EB3-OW files getting rejected....They didn't understand first...they complained through AILA and thought it was USCIS error...but USCIS said - what we did is not errror and we stand by it....and it's own precedend in 05/06 -...
Hey, nope....your wife should be fine....
check out the posts from this user, MohitFL....there is a thread in TSC - that's still active...
He filed for I485 for his wife....after his GC approval.....using follow to join clause...
I think - just stick to EAD....
Usually, EAD is guaranteed within 90 days of filing...so, she should get her EAD before October 1....
Yep, since her H4 status got invalidated....not sure if it would cascade that to H1B automatically.....but, I am guessing as per 245(k) - 180 days of illegal...
Yep, here H4 status gets invalidated....but then the law 245(k) allows upto 180 days of illegal stay....
But since, she already filed on June xx....her status is automatically defined by her pending 485....so in a way - she jumped onto 485 status, even before her H4 expired....all clean...
from the news on these forums....some folks are reporting that during Infopass or by calling TSC they got the info "July Visa number assigned"....but one may never know...until it's approved...
Better ask the senator itself, if the visa number has been assigned....
Check with your lawyer on the checks sent to USCIS - if they got deposited...that means her 485 has been accepted....that's one confirmation....
And, if you want to know the receipt number....they are printed on the back of those checks....ask your lawyer for the copy of the check images...
Check out this user MohitFL....he had the same problem....
Nope, your wife ideally goes out of status - the moment you get GC...but if your marriage happened before GC approval....then you are fine....
I believe you could use the "Follow to Join" option for filing 485....even if your GC is...
Based on the news that only 25k got approved based on July Visa Bulletin!
If this is true - the funny thing....is lot of people on this forum were assuming that their cases got approved without namecheck....that seems to be out of window now....
If the real story is that USCIS only...
