No, his company will hold his H1B and 140 till he informs them otherwise. Infact they processed his 140 premium after he put in his 2 week notice.- sgoms

I am EXACTLY in the same boat. I sent my daughter's application by mail and it was received on Oct 24th. I spoke to a consular before I sent it and she was extremely helpful and said I will get the PIO card in 4 weeks.
