Yeah, so if you two aren't married now, it is better to get him/her her with F1 or H1B. Then when you become a citizen, you can then marry and apply GC for him/her.
If she has a bachlor, she can try to go the H1B route as well. But the problem is H1B quota for bachlor holders is not big, so you might need to wait longer than you want.
If I were you, I will take the F-1 and then H1B and then marriage route. I think this is 100% legal.
But please let us...
Does she have a BS? I think the safest route is to switch to H1B after F1. I suspect when you switch from one F1 to another F1 and you are married at that point, then there might be a problem. But I have never switched F1, so I am not sure.
If you can switch to H1B and then there will be no...
I came here thru F-1, too. I don't recall someone asked me whether I have a gf/bf in US. I don't quite remember I signed the thing you mentioned.
But the fact is that there are just too many F-1s marrying in the US. I think this is a gray area. The burden is on the consulate officer to decide...
I think she can keep doing this ESL thing. Then probably after a year or two, she can switch to a Community College which is only about $100/unit for foreign students in my area. That's already three years. Long enough for my purpose. If she wants to stay even longer, she can switch to a four...
Actually I don't have a gf. I am just curious how this works. It might come in handy if I need to find a non-US wife.
As to your question, I suppose she is likely living with her parents and her parents might be able to show financial support. I just checked a local language school. It only...
What kind of fraud is that? I heard many stories here that F-1s married with a GC person or a citizen.
Plus, I only want the girl to be by my side. If marrying her will cause immigration problems, I don't even have to marry her.
Thanks for your replies.
So if the spouse can get an H1B, then H1B seems to be a good route.
But I guess the best route remains becoming a citizen and then get her in with fiancee visa. Even so, this process is still slow (ie 6-9 mos) for my taste.
What about getting her an F-1 before...
I want to know the issues related to marrying a person not in US.
I have a GC since Oct 2002. So I am eligible to become a citizen. But I am not that inclined to Suppose I marry a girl today and also apply for citizenship, approximately ow long would it take to get her to the US?
If I...
It is their application and they have right to revoke. Unlike H1B, they are not required to revoke it when you are no longer with them. They will revoke it if they hate you. Very simple. =)
This durgum guy is a troll. He already picked a fight with Jim Mills in the 485 section. Please ignore him or better yet put him on the ignore list. He has one of the most twisted logic I have ever seen. It is hard to argue with person like that. =)
Peace out..
Not completely true. You still need your employer's employment letter to file 485. Employment-based GC is designed to benefit the employer, so we are all screwed.
AC21 explicitly says that as long as your salary prevent you from being public charge, then you should be fine. There is no mention of LC salary. However, your case will be stronger if you make more than LC. Under the current market situation though, you probably should just go with whatever...
It is not necessary if you are lucky. My friend wasn't employed when his GC is approved. He got no RFE/interview.
However, if you do get RFE/interview, you must have a similar job.
Good luck!
Get a job thru EAD or H1B. Then wait for either approval or RFE/interview. If you got latter, present your new employment letter. Then you will be fine. While H1B is safer, the truth is that 485 rarely denied if you are employed by a reputable company and you didn't make any mistakes in your...
It is pretty simple. Find a job ASAP. If they don't sponsor, use EAD. If they can do H1B, then by no means pick H1B and thank them for that. Anyway, it is more important to have a job in hand than thinking about the status too much. You can always switch to other status like F1 (student)...
fdp021,
Sorry to hear about your situation. Your best bet now is of course to find a similar job ASAP. If not, you may want to find things that show you are not gonna be a public charge. I personally think UI won't affect your claim that you are not a public charge because it is an...
