    As far as I know you can still file for a H1B visa this year. Normally the cap was filled within the first 24 hours after the filing period started but this year and probably the next one there will be plenty of H1B available.

    Most lawyers state that you must show ties to your Country of origin in the sense that a TN visa is supossed to be a temporary visa and not a dual intent visa as the H1B is. There is a huge contradiction in this given that a TN visa can be renewed forever and a H1B visa can last only for 6 years.

    The appeal has been filed already; he is supposed to be legally entitled to stay in the Country until the appeal is resolved by the BIA. I guess if he goes to the interview with evidence that the appeal has been filed the USCIS cannot detain him. The immigration judge did not set a bail at all.
