But in cases of labor substitution cases where the original labor was used to file I-140 for the original beneficiary, the attorney/company would not have the original labor.     If you look at the post, the RD is 12/29/04. Concurrent filing for EB3 applicants belonging to retrogressed countries was acceptable upto 12/30/04. RD is what matters and not the ND. Visa retrogression came into effect only from 1/1/2005. Hope this explains.

    Yes..thats correct. If you don't get a direct EAD approval within that timeframe and have no RFEs on your I-140, you could as well get a interim EAD from your local CIS office (after your EAD filing is over 90 days). Good Luck.
