It should be mentioned in instructions to each form. My lawyer asked for 6 pp photos in total for 485,765 and 131. I included one extra photo (i.e., 7) just in case..:).
I didn't mean every company.. but what you are saying seems to be fair.. when company pays for all expenses expect to have 'mutual' benefit.. i.e., stay or repay the expenses. This is kind of typical. I heard some companies ask the employee to pay for his/her H1B expenses initially, but return...
I think it shouldn't matter as long as your carry a valid I-94 that is not expired . Your white I-94 might have expired in Mar 07 and the I-94 that comes with H1B extension is the new one which would be valid for next three years (or new one if re-enter US). Typically for extensions you get the...
Employment verification letter is a must for all EB applications. It is mentioned in I-485 instructions also.
It is preferable to have copies of all I94s, but don't worry most do not have it. So, all visa stamps in your passport and latest I-94 should be sufficient as evidence of status...
I do not think it is funny!!
I know many folks are in the same boat. One of my good friends is being forced to sign some kind agreement or legal obligation etc with his employer that he is supposed to stick with the company for at least two years. He doesn't seem to have a choice now as time is...
Thanks Ginnu.. My I140 approval notice did have the Priority Date, since the Priority Date field exists but empty in I485 receipt notice I was a little concerned.. Since they use the generic I-797 notice of action for all (?) receipts/approvals, I assume it is not necessary that every single...
I/We have received receipt notices for I485 (and I765 and I131) with Priority Dates not being specified. I only see receipt number, receipt date, notice date, A number etc, but the priority date field is blank. Is this typical?
I was referring to risks in consular processing with retrogression as suggested in www.immigration-law.com

06/15/2007: July EB-2 and EB-3 Visa Numbers Open and Consular Processing
* The State Department states that they allocated a large number of EB-2 and EB-3 visas...
Have you been paid at least the wage specified in your labor certification from the date your labor was filed? If so, I think, you should have not have a problem. Read through Nebraska I-140 threads and you would lot of information - especially follow suggestion by "UnitedNations". Also, there...
Just FYI -
Read the suggestions in Breaking News/updates section www.immigration-law.com on using consular processing option and see if the suggestions are applicable to you.
I do not understand why everybody is talking about USCIS making more money. In fact they are actually losing money with the current fee structure and that is the reason for fee increase. If it is really about money, they could have waited for another month before making dates current so that...
I am glad that everyone can file for I-485 and take advantage of interim benefits. I could see so many of my friends have suffered/suffering from this backlog. However, I am sad because they cannot predict better and move the cut-off dates gradually. All I needed was a moment of just couple of...
Find out if your checks have been debited from your account. If your bank displays checks online, you can get the receipt number from the back of the check and then follow the status online.
My case status shows that my application was received on 6/15, but I still haven't gotten the receipt...
My I-140 was opened and approved during the last years labor day weekend which I knew from LUDs and status message changes happened during the weekend. However, the final approval notice has the date of following business day. May be USCIS hiring contractors who work over time.
Ginnu/TheRealCanadian,
Thanks for the information. I have been under the impression that we lose H1B if we enter on AP. One of my friends recently did what I posted i.e, move to EAD informing his employer. Actually, this would be a relief for me too as I am planning to travel to end of this...
If you enter the country on AP, your H1B would be terminated and you would have to use EAD to work by letting your employer know and use I-9 form. If you can get it stamped, being on H1B is always going to be a safe bet as you wouldn't be immediately 'out of status in case your I-485 is denied'...
I have a similar question. My wife came to US on H4 in Dec' 03 and H4 stamp was valid till sept' 06. She applied for H1B and got the approval from Oct' 05, but hasn't received the SS card till Mar' 06. She joined the employer in June' 06 with the personal letter to employer that she was joining...
I do not have a reference of where I read this.. It said, there was a 'temporarily' rule to capture un-used visas from a 'specific (??)' category from previous years which made the available visas to jump. However, they do not do cingular roll-over thing every year and unused visas do go waste...
I think the fast moment is because there aren't enough I-485 filings in the system that have already reached the final approval stage to consume the available visa numbers and fill the annual quota before the end of fiscal year. USCIS has been conservative about the cut-off dates so far as they...
