Wahtever "Jackolantern" is right. Recently, I took infopass. appt. in Dallas immigration office and that officer mentioned that irrespective of country of chargeability they are supposed to approve derivative's 485 when they approve primary 485. Try contacting CIS Ombudsman. Give a shot! I am...
Thanks. Do I have to go for biometric appt. again? Why do they need fp for re-entry permit? So, as soon as I apply re-entry permit their system is going to kick fp appt immediately?
I had given at least 5 times during gc process.
Do I have to wait till I receive re-entry permit before I leave US? Some websites says I can just apply and leave, but I would have to give local US embassy address to receive my re-entry permit! Can I provide my home address in India? or Can I give my local US address, so that my friend can...
Thanks. That's what I had mentioned "Cross-Chargeability". She was born in non-retro country and visa numbers allocated based on country of birth. My lawyer requested uscis to use non-retro country visa number instead of India. She fell under EB3-ROW not EB3-India.
I just got the email and my spouse case got approved after 31 month primary got approved!!!
Just 2 hours back only I happened to this page at uscis site: http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#2
As my wife was preparing DHS-7001 form, I saw the approval email.
PD...
thanks ginnu. I don't want to spend for lawyer expenses anymore. I already did enough. I will send the form to CIS Obdusman. Do you know how long will he take to reply?
Thank you. As ginnu mentioned I will try to contact senator, congressman and CIS.
Can anyone tell what am I supposed to check for the question 10 in DHS-7001 form?
"Immigration status or interim benefit applied or petitioned for:"
thanks
Sorry to bother you. When I had searched local congressman at http://www.contactingthecongress.org it gives 2 senators and 1 rep. So, rep. is the congressman? Can I contact anyone or all 3 of 'em? Do I have to call them? or Contact online?
Residents of the 75063-4145 ZIP code are...
Thanks. I never made any request to congressman or senator. There are couple of counters at Dallas immigration office. I just met one of them. He only said someone worked on my wife's case on 10th, but no LUD or status message change. I think as usual they hold the case forever.
thanks.
thanks ginnu. Is it possible in my wife's case? Do you have any idea? When I had visited local Dallas office, the officer mentioned that you can write NSC to transfer the case to TSC. Thanks.
I used to live in Michigan when I had filed myself and my wife's 485. We have moved to TX two years back. My case got approved 3 years back.
Can I request NSC to transfer my wife's pending 485 case to TSC? What's the procedure? Will it happen smoothly? My concern is they shouldn't say later...
As per my lawyer, CC can be applied if the PD is retrogressed for a long time. Many primary cases have been approved using spouse country of birth (CC). Why not in this case? They should have approved her case when they had approved my case. It was their mistake. Even, in Dallas immigration...
On Feb 1st my lawyer requested NSC to approve her case using CC. Today, I was informed (Dallas immigration office) that an officer looked into her case yesterdat (02/10); but there's no change in the case status.
Thanks for the tip.
I got the info pass appt. and visited local office. As per the officer:
My wife case has been pre-adjudicated in 2006 and it seems an officer looked into the case yesterday. I had checked the status online and no change for the past 6 years.
He said that her case...

Primary got approved 3 years back.
Spouse still pending...It's been 7 years since we applied 485.
Spouse was born in non-retro country.
On 1st of February I had requested (SR) USCIS to approve my case using Cross-Chargeability.
I have received a letter...
