Hi:
Has anybody used AC21 portability while doing consular processing?
I was laid off before 180 days while doing AOS in US. After that I worked for a new employer for a few months using EAD before moving to Canada as PR. This new employer is willing to offer me a job again. According...
I'm a canadian PR living in Canada and as well as doing consular processing.
I need to visit US urgently before consular interview. If I apply for a visitor visa, will that affect my immigration petition i.e. ongoing consular process?
Many thanks in advance.
Hi:
I'm a canadian PR living in Canada and also going through consular processing for US immigration.
I need to visit US before the consular interview. If I apply for a visitor visa (NIV), will that have any impact on my petition for IV i.e. consular processing?
Many thanks in advance.

as per the attorney I consulted, it is possible to go for CP if you had been in AOS for at least 180 days using your current LC & I-140 (just as you'd do if you're in AOS using AC21).
I hope this would give you some hope.
Any comments on my thought??
In order to obtain canadian citizenship one must have physical presence of 3 years as PR in Canada. There are few exceptions to this rule. One is to be employed aborad by a Canadian business.
My question is if someone (canadian PR) opens a consulting firm in Canada and then become employed...

Thanks for your comments. However, what's the basis of your comments? Is there a document/ known case to confirm that CP is not possible using Portability reg?? Please share if you know of such evidence.

I'm in Canada now.
Thanks.
Thanks J. Mills.
Yes, I left US with a valid AP. I was working for another employer after being laid off by the sponsor until moving to Canada. Now, if the new company file for a new H-1B, will that void my current AOS process??
Also, Do I have to go my Home country for H-1B stamp? Can I...
Thanks ginnu.
I have a few more questions:
1) Last time (in Oct 2002), I entered US using my valid AP from Canada, I was not given a new I-94 (may because my passport was stamped "paroled until April 2003" during first re-entry to US). The officer at the airport only put a note about...
I'm Canadian PR currently living in Canada. I want to switch from ongoing AOS to CP.
Can I file CP petition in Canada rather in my Home Country?

Bdeshi
Many thanks to all of you.
As a matter of fact, I'll be consulting an attorney next week regarding my situation. I'll post what I hear from the attorney.
Thanks Mercury6 for sharing your case.
My new employer may be willing to sponsor me for CP. However, I,m bit concerned as I was laid...
Thanks Murcury6.
Yes, I was granted parole in US until april 2003 ( one year from the date of my first re-entry).
Would you please share what happened to you? What did you do?
Thanks again.
Just Curious?
If I enter US now as Canadian PR without a visa, how will INS know that I re-entered US after my AP has expired?
I landed in Canada as PR on Sept 02, reentered US using AP in October 2002 and moved back to Canada in the same month. My AP expired in December 2002. I have been...
Hello Gurus:
My situation is bit complicated.
I'm currently doing AOS. However, as I lost my job before 180 days, I moved to Canada as Landed Immigrant.
Now I want to return to US and work. I've used only first 3 years of H-1B visa and did not apply for an extension after getting EAD...
I recently moved to Canada while doing AOS in US!! I've valid EAD but my AP expired this month.
Must I have new AP to return and work in US (since no visa is required for citizens of Commonwealth countries)?
If not required, can this create any problem during GC (US) adjucation...
I'm in the same boat as Texas. I moved to Canada as Landed Immigrant while doing AOS in US.
I've valid EAD but previous AP expired. Must I have new AP to return to US and work?
If not needed, will this cause any problem for GC (US) in future?
regards.
