If you have been laid off, under what status do you intend to reside in the US? Visitor status only gives you visitation privilege, not residency privilege. Secondly, generally after leaving a job on TN and going back to Canada, CBP would want to see you have established home ties in Canada...

When you ask the employer to sign and send this custom letter that you are authoring, wont they ask why you want them to send this letter? I would argue instead that the moment you include the "end of the letter" lines, they will know you are asking for something that requires sponsorship...

thanks for clarifying. I believe the OP already has 130 filed though so basically dont bringup with the POE officer voluntarily of course unless asked. When I got my TN, I had 130 filed for me also but to be fair, the officer never asked. Not sure how he would have reacted if he had asked me...
if you have a solid package, I'd rather go to POE. Its probably best to go closer to the expiry date. Even if the POE were to give you the renewal 4-months before expiry, you would have lost out on 4-months of a previous authorization
nope you are fine. If they ask, of course tell the truth that a 130 petition is filed but that it will take 15 years and your TN work assignment is only a 3=yr temporary assignment.
Also, its the filing of 485 that signifies dual intent not 130/140
whether you apply at border or through USCIS, it has nothing to do with changes to NAFTA (if any). Both method work of course although getting it at border is probably better/faster as long as you have a solid application package.
