Oh well, the 60 days will be up in a week and still no sign of the AUSA :( I've sent my attorney an email to see if we can enter a request to the judge to enter a default judgment. He hasn't replied yet. Very frustrating :( Some say no attorney wants to represent the Trump administration and...

I have also filed for WOM.
Interesting scenario! Usually in order to be able to come back to the US (under any non-immigrant category) after showing immigrant intent, one needs to re-establish pretty strong ties in Canada. Rule of thumb: it is recommended not to try to go back for a couple of years after showing immigrant...
Thanks for the reply. During Bush era, I was harassed by CBP at US-Canada border three times. They took me to the 2ndary inspection and kept asking if I had a passport from my POB. I even got a funny story about it but I'll tell you about it later. They eventually gave up on this nonsense...
Yes it is just the start of the WOM. We just filed it on 3/30. My 485 has been pending for 20 months. I do think I am being CARRPed just based on my place of birth even though I am Canadian. And I am not a Muslim either. The pattern is so obvious. Anybody who is born in Middle East, North...
Not sure when. The lawyer is handling that. He served the summons 2 days after the judge's order. I guess he is waiting for the gov't lawyer to be assigned.
I am actually surprised that you say you are surprised by this judge's order! I just went thru a whole bunch of mandamus cases on Pacer and saw this order over and over repeated in a lot of cases. This is the norm. Basically the judge tells the parties to confer and settle.
Nope. This order was issued 2 weeks after WOM was filed at the court. The 60 day clock starts after the issuance of this order. According to the lawyer, "conferring with plaintiffs" means: settle outside the court and don't waste taxpayer's money! There will be conference calls for settlement...
Hi, my WOM case is for I-485 (EB-2) but I'd like to hear from the experts here what they think of this. The judge issued the following order after my sponsor's lawyer filed the WOM. He says this is good news that the gov't has to confer with us first. What do you think?
"This matter having...
I am not sure if the new 60 day rule applies to F-1. The poster's status is clearly F or J and he/she is not on any type of work visa status (H, L or TN). The 60 day rule is supposed to be for work visas. I would apply for COS to B2 if I wanted to stay beyond my OPT. Or if you find a job, then...
Welcome to Trump's 'Murica! Just like Nelosna said, the officer was BS'ing you big time! I bet my bottom dollar the CBP officer you ran into is a Trump fan. They are in desperate need for RN's here. What the heck is that officer smoking?! There will be more incidents like this in the next 4...
That was my point too but I applied it to EB-EAD/AC-21: One cannot take on a contract job while on EB-EAD and invoke AC-21. On the list of pros and cons of EB-EAD vs TN, this is a con for EB-EAD. If one gets laid off by one's GC sponsor, he/she can only take on perm positions that are...
What do you mean GCs are not for contractors?! Of course a GC holder can take on a contract work instead of a perm position. I actually might consider it when I get my GC. There is tons of money to be made that way. The only drawback is health insurance.
As for my sponsor, if they lay me off...
I haven't given up yet. Filing a WOM shows that. Life on EAD, however, in my field is not an easy one. Most jobs in my field are contract jobs. I cannot invoke AC-21 if the job is a contract one. On top of that, these days USCIS requires you to file a form called I-485 Supplement J in order to...
I'd like to share my experience so far on my TN-to-GC journey. I was a happy man on TN, H-1B and then TN again for 12 years. Unfortunately my I-485 has been pending for 1.5 years and it has been stuck in background check due to my place of birth. It has got to the point that the sponsor's...
You shouldn't worry too much about the chances of getting a new TN approved/rejected. Big companies rarely get rejected. And by the way, a 2 week notice is not really required and it is only a courtesy notice. I have given zero day notices before and used immigration as an excuse that I can no...
