I don't think its a typo. My AP filed on Dec 3rd 2004 and got approved today.

I am another Dec 24th filer. Still waiting for I 140 and I 485 approval. EB3 in NSC. So hopefully my time comes soon...... :D

May be you both applied for second EAD and that may be causing LUD changes...

As per Ohoto memo..I 140 will not be processed till I 485 is ready to be adjudicated..So till PD is current..I 485 will not be adjudicated..hence, I 140 will not be processed also. This is my understanding..I am still waiting for my attroney to reply back. Its a big vicious circle of catch 20...

I left job before my 140 is approved. I used H1b transfer for my new job. Not yet sent AC21 letter, previous employer promised he will continue the process. I will send the letter only if I get a RFE.

I agree...I saw lot of 485 approvals last week for 2002 filers. People who were planning to use AC21 like me are screwed.

are you sure it is Jan 2003 not 2004? if 2003, you should talk to USCIS immediately for your i-140 atleast.

yes if you can prove that you are experiencing hardship because of delay in your i 485 like not able to get promotion or not able to get education loan etc., If you are Indian than Bombay consulate is accepting Attorney certified cases. I heard Chennai also does.

So Ohoto memo is useless huh? Its frastruating that more and more cases looks like they are not applying ohoto memo for before April cases and still not approving concurrently filled I140. I don't know whats going on inside NSC
