Thank you 'newacct' for that info. I heard that the gov, has a free tax submission online for residents. Is that true? If so can I use it if I have been on F-1 for more than 5 years and reside mainly in the US (i.e. pass the test you mentioned?)
Although my application was for the Rosedale AO in NY, my timeline is below. Despite having my interview within a reasonable timeframe, I have no result.
Thank you for the info - although I doubt bringing up that fact in a matter of fact manner will land me a job! What is the tactful way of answering the "are you a permanent resident" question?
I notice that a lot of jobs list they require perm residency/citizenship. Is this only because they don't want to fund/support a visa or are these really strict requirements. Are people with EAC's able to land some of these jobs?
I am not sure, but I've heard that if the decision is bad, they prefer to deliver it in person - because then you cannot claim you never received it - since you physically pick it up. So perhaps it is good news!
I have not even received my asylum yet and I fear I will also be waiting a very long time. If some of you decide to pursue a class action lawsuit and I am eligible I would certainly join. If not I would still cheer you on and become involved somehow. Maybe we can get a lawyer to do it for...
To clarify, the law does not immediately grant a waiver to a student in lawful status. As I've said before, and as is stated in the section of law you referenced, it is up to the discretion of the judge/AO. See below;
(5) The term “extraordinary circumstances” in section 208(a)(2)(D) of the...
You were right! According to USPS tracking, that is exactly the date I should expect my card!!! I just hope my asylum gets approved too. I cannot figure out what I would do without it.
I have multiple entries into the US from my home country from which I am seeking asylum. In my interview the question of why was not even asked. Nor was it included in my application. (Although there are valid reasons). I agree with mercier that the 1 year deadline is enforced to everyone, in...
I am not sure if re-entering another country would count (probably?) Obviously don't go anywhere where you think you will be in danger, but the law is very strict on the 1 year deadline. *Sometimes* they provide leniency for students in good standing as you say, but it is *not* a sure thing by...
According to what my lawyer has told me and what I have researched online, the reason majority of cases are denied is because they don't apply within 1 year of last entry. If your *last* entry was longer than a year ago, I would recommend re-entering.
Some of us end up waiting a long time after the interview. My interview was in October, and I am still waiting. I have heard that the decision is delayed when one is in status (as opposed to being out of status, entered illegally etc). I just got approved for work authorization, am still waiting...
Hey Johnny,
I am in a very similar situation (PhD student, 2 year rule applies etc) so I would like to share my experience/knowledge with you. I've researched these things, and some took me a long time to figure out, I will answer to the best of my knowledge. See answers in bold below.
You can apply for a EAD after 150 days have passed since your asylum application was received (and not a day before - or it will get denied) - I believe you apply for the SSN after you receive your employment card.
No idea about DMV - each state may have slightly different rules.
They received my EAD request Jan 31, I saw on the USCIS website that they sent an approval decision on Feb 26. I am so relieved. I guess I should be expecting my card soon too right?
