140 applied in EB2, RFE to change to EB3, but approval in EB2

No Title What he does may be correct, what he is saying is not. The I140 is readjudicated again at the time of I485. So it category does matter. No I could not go for an amended I140, later found out - imminfo.com etc.. that is the right way to do. Even my lawyer said the same thing - it...

140 applied in EB2, RFE to change to EB3, but approval in EB2

No Title I am not a lawyer, so do not take it as legal advice. What happens if you wait for 18 months of 485 and then they tell you that you have filed in the wrong category?? By not asking for amendment now,You may lose 3-6 months or the whole 18 months in responding to the query. Can you...

140 applied in EB2, RFE to change to EB3, but approval in EB2

No Title Welcome to the group, I suggest you apply in EB3. Try getting an amended I-140 to indicate that you want to be in EB3. this should be an expedited process 4-6 weeks. This is exactly what happened to me. As per my lawyer if dates are current in both EB2 and EB3 it does not matter...

Can We Discuss On This Issue

No Title transferring a case to local INS is the figment of the IIO\'s imagination. It is like a parents telling a kid that they are going to a Doctor\'s Clinic when they are actually going to a Movie. Lobby using ISN, that is the only option

    What Kind of Sadism?

No Title It may not be a bad idea. You would think that H1B guys would be printing themselves GC but legal immigrants are much more careful atleast in their Pre GC days. If the IRS can employ them, why cant the INS? The intent of ACTA seems good. If INS cannot deliver in 6 months, let us go...

    What Kind of Sadism?

No Title Quote from the chat : If the Petition was not filed till after Oct. 17, 2000, then a person should remain with the sponsoring employer for about 6 months to 1 year to be on the safe side, after getting the GC. Here is another piece of info : INS is not accountable to any legal...

    What Kind of Sadism?

What kind of people are employed in the INS? As per Sheila Murthy the interpretation of the ACTA law for I 485 is that - only those who file after Oct 17,2000 are eligible for job change. The bureaucrcacy corrupts even the good intention of the legislature? Are they in league with the companies...

    485 denial

No Title I have heard of about 5-6 cases. Is it the EB2/EB3 confusion? If it is and u have filed under EB2 when the dates were not current for EB3 then you have a problem.

Is it true: that 9/99 to 3/00 cases have been transferred to local INS offices ?

No Title 3 months is a gray area. It could be for a number of reasons - officer on vacation, RFE etc.. If we see approvals for Aug 00 then we have a problem. But here is what Ron says - \'If you get a out of turn GC the INS can take it back\'. I want a Permanent Permanent Residence card.
