Folks,
If you are from country other than india/china and have done FP, do you have any news to share about your case status? Have you called IIO recently to check if it is taken up for adjudication?
thanks.

I don\'t think you have to xfer H1. The only advantage in xferring H1 is if your current 485 gets denied for some reason, then you don\'t go out of status, since you have an H1 status. INS doesn\'t require you to file H1 to file for GC (remember GC is for future job and strictly...

Hanuman,
With that amount of H1 left, I think you are perfectly covered for almost all the risks. Do start your GC from new employer ASAP ... I can\'t emphasize this more. Starting this process doesn\'t cancel your existing filing, but it is safer just in case. Also, this time...

Hanuman,
Good to see that you have taken a decision. Do ask your new company to start your GC "ASAP", with RIR labor and EB2 I140 if you qualify for that. Also, most probably you\'ll also be able to retain your current PD.
I think you have taken a bold decision and good...

Hanuman,
This is a really sticky situation and it\'s very difficult to say what would be the right step to take. However, here are the possibilities ...
1. If you change job before RFE and RFE is about employment verification, it is very likely that your case will be transferred...

I think that is pure baloney. They have skipped over oct99 thru mar00 cases for india/china and issued FP for all other 485 filers. Unless vsc has hired teenagers, who believe halloween isn\'t over yet, I think this was done specifically for some reason. CSC had also skipped over a lot...

Frankie,
No offense but it looks like the IIO was screwing with you, although politely. My ND is Jun00 and the IIO said ... let\'s see, we are processing sep99 and you are jun00, so your case will take 9 more months for adjudication [I could make out that she was trying to count the...

I can understand why you want to get back to H1. You probably won\'t have to leave the country to get an approved H1B petition (I129) but you might have to go out to get a H1B visa stamp. Still consult with an immigration lawyer, for your specific case.
Can you also tell us if you...
Have you recently talked to IIO at VSC? Any news if your case is with an officer for review?
I just read a posting that someone\'s colleague from \'other\' country, with ND in nov99 and FP aug00, recently got approved. From your previous postings, I know your case is similar and would...

Can you please ask your friend to post some information about her case here? such as EB category, PD, RD, ND, FP, EAC# and Approval Date?
Thanks.

Did you recently move into NJ? Did you file your 485 from some other city/service center? Your information in this regard will help us understand how VSC treats cases after a significant change of address or service center. Thanks.

Dipika,
This is clearly a mistake on part of VSC and I don\'t think you have anything to worry about.
Here\'s some suggestion ...
1. Call up VSC and get as much information about the RFE as is possible, such as when was it issued and when was it mailed (VSC has acknowledged...

Hanuman and klm,
Reading your posts I think you have other serious problems to think about than RFE\'s. You should be concentrating your energy and time on those issues than worry about GC.
First of all, the GC problem has an upper bound on time; you\'ll get it sometime -- most...

Hanuman, this is actually a positive development for you. Your PD is not current and your case is being reviewed. Imagine what your state of mind would be, if you had to wait to file 485 until your PD is current. In your case, the worst possibility is you\'ll get your GC as soon as...

Whatever action you take, do make sure that the onus is not on you to prove that there was no intent to fraud. Since your PD is so close to getting current, I\'d recommend that you wait for the next visa bulletin to see if your PD gets current and then go for stamping.
