So I take it the last time she entered the US she snuck across the border?
Well she's out of luck then. You can't get a green card if you entered without inspection.
I have nothing against F-1s and studying, just this person is going to drop out purely because he doesn't need an F-1 to maintain his legal presence. He's not here to learn, he's just using the F-1 to remain in the country.
Forgive me, but that's bullshit.
Illegal aliens are not relevant...
You lost your job though, right? An intended immigrant's income can only be used if they will continue to be employed by the company that employed them before they applied for AOS.
Personally, I think you should be lining up a co-sponsor just in case.
You don't need a state ID to get married, the birth certificate should be fine. Also you shouldn't need a SS#.
You'll be fine. If you're worried to much, go get married in Vegas, they don't care who they marry there. :D
The answer is "No" unless you filed an I-485 before. It sounds like you didn't so, "No".
You need to include copies everything that went with the tax return, so 1040, W-2s, any 1099s etc. If you don't have this, have the IRS send you a tax transcript, which is a good alternative.
Correct.
How long have you been here on H-1B? You can use your income on the affidavit to bolster the amount earned. Did you wife taxes jointly with your wife for 2006, or did you get married in 2007?
If you want to quit school then yes, you can. Your F-1 status is now invalid due to the fact you have filed for AOS. The AOS application gives you legal status in the USA, you are no longer reliant on your F-1 to prove legal presence in the USA.
Nice to know that you were just going to school...
Sadly that doesn't cut it any more. I had the TB skin test despite having the BCG when I was a kid, the doctor told me that, yes it would probably come up postiive, but if he didn't do it USCIS would reject the medical. As it happens it didn't come up positive.
AOS is a two step process. First your USC spouse has to petition for you to get an immigrant visa number (I-130), then you have to apply yourself for your status to be adjusted to that of a permenant resident (I-485).
So your USC spouse needs to file I-130 on your behalf, although luckily you...
Anywhere from 2 months to many years depending on how things go. Average is around 6 months right now I believe.
If you apply for an EAD when you apply for AOS, it should be in your hands within 90 days of USCIS recieving the application.
Many of us have been in the same situation.
Make sure you...
I would guess that they would have sent you an "Request for Intial Evidence" letter if they had lost the medical. That said, I would say that what they have done (including the forms with the interview letter) is extremely unusual behaviour.
You should have filed everything together, yes. However all is not lost!
You can file your I-485/I-765 together to the Chicago Lockbox, ticking "A" on the I-485, part 2 question, and include a photocopy of the Receipt Notice you got when you submitted I-130. Your I-130 does not need to be...
They won't ask that. Why would they? You're over thinking this.
They will ask the standard question in the I-485 form, i.e. "have you ever been arrested, cited, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, excluding traffic violations?"
Your answer to...
Here is some good advice that will help you when dealing with USCIS: Never volunteer information unless directly asked for it. As a lawyer friend once told me, if a USCIS officer asks you if you know what the time is, your answer should be "Yes" or "No".
If you weren't formally arrested this...
Your doctor really should have given you photocopies of the stuff in the sealed envelope. However I wouldn't worry to much, unless USCIS have lost the original you sent them, its unlikely they'll ask you for a copy.
