I don' t think BCIS asks for such a commitment, only the job duties, salary and prospect (continued interest). For AC21 cases, the new employer will usually refuse to mention the LC in a employment letter. I don't think that is a problem if the employement is full time. For hourly employment...
If you get an employment based RFE, you will have to provide a letter from the employer stating
1) Job duties
2) Salary
3) Prospect for continued employment
and usually couple of W2s and 2-6 months of recent paystubs.
TRC - do you have any idea what the effect of a much higher salary is for a AC21 case (description and skills involved are the same) ? I was grossly underpaid when I started working and got steady raises over the next 4 years. The new job itself did not create a spike in salary. However...
I have seen a bunch of posts that deal with issues where the salary with new employer is substantially less than LC. It seems that BCIS does take the current economic conditions into account and have approved these cases too. That is, a low salary is not, by itself cause for denial of a I-485...
Re: I thought Ms Murthy was only a
I beg to differ on that one - Ms Murthy is not quite "only a immigration attorney". Ms. Murthy and her Law office has a strong track record of successfully representing the most difficult cases. Not only that, that law office is now a premier destination...
thanks guys - I will not hit the panic button yet, and yes, the job change was due to a layoff. I wouldn't have changed jobs before the approval if I could help it. The RFE asks for a employment letter from the employer who filed the I-140. Thanks for the responses, all
Can anyone recommend a lawyer who can represent a AC21 case (changed jobs < 180 days with prev emp)? Current salary and job is similar to previous but only issue is that an RFE has been issued for a emp letter from prev employer.
Dilemma
I saw online that an RFE has been raised on June 12th. Till date I have not received it. Given BCIS's track record, I don't even know I should be concerned or not.
The funny thing is the website says "contact service center where application is pending if RFE is not received in 14...
guys - thank you all very much for the discussion on this thread. I have seen online that I have been issued an RFE. This discussion is definitely helping me preparre for it (I am pretty sure the RFE will be on Employment stuff).
the approvals we have seen for Dec is actually a very small fraction of the total applicants. So, hang on for the loooong ride. Knowing BCIS's track record, I have braced myself for the long haul.
wow - I could have made the post myself. Our cases are so similar it is scary. My FP is much later that yours and I don't have an RFE yet. This is what I plan to do if I get a RFE - if employment RFE, then a cover letter from the lawyer will explain the eligibility under AC21 and outline the...
Sorry but I got locked out for too many enquiries - it is better to distribute the work.
