One of my friend faced problems
This is because he said that once they scan your AP, it would say invalid /expired since your 485 is approved. From then on they start questioning you.
If you are unlucky they might not let you enter.
I leave the decision to you.
Your Lawyer is absolutely wrong
Don't leave with your AP. Get your PP stamped or wait for the card. Don't make such unwanted mistakes now that you already have your 485 approved.
No
If you have had either active , you'll have to prove that you took all the necessary medications.Contact the local health dept and they will prescribe you medicine and a certificate at the end of taking medicine. I think they expect you to take medicine for 9 months.
If you have inactive...
For Bio after June 17
For most people who did Biometrics after June 17( I am only talking about those whose 485 is already approved),only LUD has been updated. There is no message change. I heard this from 5 different persons.
Cannot travel in AP
Go nnd get your passport stamped with your 485 approval notice before you leave the country. After 485 approval AP and EAD becomes invalid.
Bill
There is a bill in Congress to increase the quotas to 480000 visas. I think the best bet for you guys right now will be to push that somehow instead of lawsuits and others.
I know it's a pain
I had the same problem. You need to wait an hour to get a new appointment. But think about how much we have all gone thru' to reach here. It's just one more easy step.Take it easy.
Usually You can get stamping done for both of you at the same time.Just tell them that you have...
Why can't you get one more appointment on a safer side?
Why can't you get one more appointment on a safer side and then deal with it once you go there?
Better Safe than Sorry.
Only for your wife
You should not have any problems.
But who knows? If you get an inexperienced(Dumb) immigration officer your wife may also get approved.
Most Likely a problem!!
If you are Out of status for more than 180 days, there is a very good chance that 485 will be denied.
From your post above your wife had been OOS for more than 180 days.
So Please be prepared either way.
Misinterpretation
I think the term 'current' is being misinterpreted.Just to clarify , It means that Visa bulletin PD <= your PD.
Currently Service centers will process any EB3 application for retrogressed country whose PD <= 03/01/02.
Non concurrent
My Labor PD is April 2002
EB3
Nebraska SC
I already have my I485 thru my spouse(RD Aug2003).This is just my backup in case something happens to my spouses petition.
