smkr999, Because of unavailable visa number under EB3 category, all I-485 applications under EB3 category are currently NOT processed. New visa numbers will be made available from October. You may have to wait until then to see any changes on your I-485 application.

It seems that your employer has reused your labor again for filing another employee's I-140 petition.

To my knowledge, the II40 for the second employee will not be approved. It would be denied because the labor is already utilized by the first employee. Had the first employee had left the company prior to 6 months completion and then the I140 was revoked then it would have been a different story.

Just curious! If the employer had indeed used same LC twice, how could the I140 be approved in the first place? I have heard cases of I140 being denied because the labor was already used but so far I never heard of I140 approved and later revoked because of missing original labor.
