Priority date in my 485 notice is blank but on my fingerprint notice its 05/05/2003 which is same as my 140/485 RD, though my labor was filed in 09/2002. Good news.. may'03 filers getting RFE, Can you tell us your Priority Date? RFE could be about EVL.

Only problem in January for some of us may-03 filers will be that our priority date may not be current at that time. Anyway you look at it there is a long wait.

I hope they are doing this to issue plastic card as soon as 485 is approved so as to reduce the work related to passport stamping. But you never know these stupid people can cancel passport stamping and not come up with the idea of wat to replace it with.

Does anyone know if May-03 NSC 485 filer wud be affected by priority date retrogressing in future? I believe 485 adjudication is put on hold unless your PD is current.

Looking at the standard operation procedure for I-485 recently posted on this site, it seems that they check for the availability of visa number just before adjudicating 485 and if its not available then 485 is not adjudicated and waits till visa number is available... so old time filers may get...

I eFiled for AP on June 1st, at that time the the photo requirements were not changed to passport style photo, I still got an RFE to send new passport style photo. I sent them and got approved recently. Maybe yours is the same RFE.

I eFiled June 1st, Not approved as yet. Got RFE on Aug 16th.

I eFiled my AP on June 1st, on 16th August I got RFE to send Passport style photos. They recd it but no decision yet.

To maintain H1 status you need to enter US using H1 visa, if you use AP you status changes to Adjustee.

It doesn't hurt to apply for interim EAD. Generally they will not issue it before 90 days have expired. Tell them you will lose you job, take a letter from your employer.
