the certified ETA750 form will be sent to lawyer only. so just be patient and wait couple more week until your lawyer receive it. in the worst case, the form gets lost in mail, which is very unlikely. even so, your lawyer can ask DOL to issue a duplicate one. Can you share more information...

you have 35 days to file the rebuttal and if you request for extension, you get another 35 days. I don't think salary is a issue in your case since the DOL did not mention it in the NOF. also it seems your current salary meets the requirement.

prevailing wage i think in your case the 2003 survey should be used. maybe you can argue different Level should be applied. what is your current wage level? level I or II?
