You may have to get it from your home country
As long as you have valid visa, you have no problem. But if you have an expired visa with an H1 approval.. the new law will not allow you to return. They will stop you at the border and ask you to go to your home country and get the visa stamped...

the lawyer said .. new law will not allow you in if you dont have visa stamped
the lawyer said. the law which allows people to return on Approval notice alone is temporarily with held.
If you dont get stamping or if you dont have a previous valid visa (not expired) then there is no problem...
(F1 visa being expired, but never out of status).

My F-1 visa was valid until May 2000 (both on I-20 and Visa as well) but I did not finish my MS. Did all the course work but dint not finish the
project work. My OPT started on April 2000 and will end in April 2001.
Meanwhile my school extended the time to finish the project until the end...
