Probably not. If you are a fresh H1 applicant and you are not a Master's degree holder from a US university, then it will be a problem. But in that case, I dont think that the USCIS will even accept your application.

My application was received on May 26th and I received a receipt notice dated May 31st. But my H1 is not a fresh H1B.
