***********So, Is our I-485 Litigation Over?*************

RajuM The examples you gave are proper for their respective cases, but they do not apply here. The basic idea is that processing I140 and I485 are similar and need similar skill set. Once the security check is cleared, the job left for the officer is to review the case and probably click a...

***********So, Is our I-485 Litigation Over?*************

Thinking from the process point of view, the only way you can reduce backlog is by reducing the amount of time an officer spends on a case. So in a given time frame, say a month, an officer can work on more number of cases, resulting in more case processed, eventually reducing the backlog. I...

***********So, Is our I-485 Litigation Over?*************

The concerns are well justified. I read it several time and below is what I could make out. The program will be launched on after April 30th and will apply to cases which are ready for adjudication i.e FP cleared. The memo does not say that the process will apply to cases received after April...

    Status Scanner tool ?

The macro already does it. When scanned the first time it creates a worksheet with the name of yy-ddd with all the I140 cases. The next time you want to scan do not delete that worksheet, just run the macro again - it will scan only the case numbers in the worksheet that are not approved...

Should I or not ... (EAD, H1 extension)

hakoonamataata As your I140 has been approved and 6 months have passed, there is no risk in using EAD. You do need to renew your EAD/AP every year till your 485 is approved. Similarly, you need to renew H1B also. Using H1B will turn out cheaper as you need to renew only H1B and H4, if...

    Finger Prints!!!

ice9 The local ASC will schedule your FP and will send you a letter when its time. The usual time is about 10 months from filing I485. If you do not like the date, you may request a rescheduling by calling the local ASC.

    Change of address - Unbelievable!!!

Indeed! The I140 is the employer application and any change should be requested by them. You are only the beneficiary. Anyway, it is not important to change your address on the I140 as all correspondence will be done with your company.

Is this true or BCIS is bluffing? Please share your experience

Below are my responses from what I could make out from your message. Customer service representatives giving incorrect info is not uncommon. The online message is more reliable. The best is to wait 30 days for the notice. CIS do not send notice for RFE responses, only the online message...

    Extension of EAD

I guess you are referring to the receipt number. There is no such thing as the tracking number for the CIS. Each application has an unique receipt number. So yes, your application will receive a new receipt number. Hope I have answered your question.

    EAD Approved

The same happened for us. My wife's EAD was aproved in late December. In my case, there was no update for two more weeks, then they requesed new photos. I sent the photos the next day I got the letter. More than two months later, my EAD is still pending. Hope, your husband gets a better deal.

    FP Notice.........

A friend of mine who applied I485 in May'2003 got his fingerprinting done in March - about 10 months. You may look into the trackers, that will give you a fair idea.

Delay in publishing processing time I guess, CIS reallocated their statisticians to defend the lawsuit.

    Help needed.

Copy should be fine. The receipt notice contains the notice date. There will be separate notices for each applications. The notices for I140 are sent to the employer and receipt for I485, I131 and I1765 are sent to the applicant. It takes about a couple of weeks, after that you can call...

Here is the Govt's Response to The complaint

ImmigrationWatch.com is bogus Edison, Nemesis The analysis presented by nemesis is nice. But the underlying data from ImmigrationWatch.com is wrong. From the site, if you add up the total number of cases across the service centers by case type, the numbers reported by them falls far short of...

    LOST RFE I-140 Eb2 Nov/2002

If the RFE is not received your company lawyer can inform the CIS by calling them. They would send another notice. Correspondence from the CIS is usually lost if there is a change in address. Has your company address changed after applying? You said the RFE was issued on March 3rd 2003. Is it...

Jan and feb cases are bing proceessed

ImmigrationWatch.com is bogus We all know that there has been a lot of approvals from Mar-Apr-May during the last two weeks. That site do not seem to list those info. There are several more reasons for me to come to the above conclusion: The numbers reported in that site are far too less to...

Shouldn't CIS have posted processing time yesterday?

Agreed, but not many H1B applications are received before October. According to last years statistics, they received about 15,000 cases before Oct'01, which is about 2500 cases per month. While, after Oct'01 it went up to 15,000 per month. H1B processing should not require significant...

Shouldn't CIS have posted processing time yesterday?

Looks like the H1B cases are done, the date for new I129 is Feb 20'04. CIS stopped accepting H1b on 17th Feb. The H1B resources should be fully available now for processing I140. We should see more approvals in coming days.
