The loss itself doesn't mean that company cannot pay offered wages. Company may have cash from previous periods or may just borrow some, you know. Good indication ability to pay is actual paying offered wages :)
look at the timeframes for Nebraska... It's way over 3 month in average, looks like 5. Then USCIS wants to stop concurrent filing of 140+485 so, then there will be much more point to go premium (gor those with current PD) and sponsor the USCIS :) by extra grand.
May be either you lawyer did not file or it got lost somewhere or your lawyer goet the receipt but didn't tell you. Better to do somthing, like initiate inquiry to INS.
I don't think that EB2 i140PREMIUM processing is available... they've just implemented it half a month ago for certain eb3 cases. There should be official announcement that they are expanding the program, but I haven't seen one.
