Hi, If someone applied for a labor and then applied for I-140 which got approved and then he left the company. Can I use that labor to file for I-140 again (as a substitute labor). Because of this new rule that no substitute is possible after July 16, please asnwer at your earliest. Thanks

I think EB2/EB3 category is decided at the time of filing labor and not at the time of filing I-140. This is what I have came to know from my lawyer. Are you guys think it differently?
