I was in a similar situation. My I-140 got denied and I sent to AAO for appeal (decision is still pending). Extended my H1 based on appeal. In the meantime applied for a fresh labor and I-140 from a different company that got approved.

royl66 - I would check again. I don't think the statement ur lawyer made is true that u don't need to change to company B. I am pretty certain u need to be on company B's payroll for sometime else u will have problems later...
