    eb2-niw: is my qualifications/background sufficient?

eb2pharmacy, In addition to suggestions provided by others, what I would suggest is to focus on how you will justify that your previous work and/or your current job is in national interest. This is a very important aspect of the NIW petition. As far as your publications go, citations are...

    Travel while NIW in process

    1) Yes, it should be ok 2) You should not have a problem, because H-1B is dual intent. Replying anything other than yes would be lying.

FPGEE and Degree and Transcript attestation?

Hello, I am planning to take FPGEE next year. I was looking at the application material and one of the requirement is to send sealed copies of the transcript and bachelors degree as part of the application packet. However, I am not able to get the degree and marksheet attested and sealed. I...

I-140 filed waiting for approval and H1 extension

moon 123, In my opinion, you should file for H-1B extension atleast 3-4 months prior to your current H-1B expiration irrespective of whether your I-140 is approved or not. The reason why I say that if you cannot file I-485 due to retrogression, you need to have a valid visa (or approved...

    140 urgent question, please read!

Allaboutgc, To the best of my knowledge (and I am not a lawyer!!), the I-140 petition is filed by/for the benificiery (you in this case). Since your husband did not file I-140 and was a dependent on your petition, the answer should be "NO". I would suggest you to visit www.murthy.com forum...

    age for applying I-140

startrek2005, To the best of my knowledge, age has nothing to do with applying under NIW. This makes me wonder whether your lawyer is "old enough" to handle your case :). I am sure a lot of people in this forum (including me) will be interested in knowing where your lawyer got this information...

things to do after the job change for pending NIWers

forxp, Thanks, based on the discussions, I think it will be easier to "justify" similarity in the field if one plans to "link" I-140 approved in the EA category to I-485 as compared to demonstrating working in "national interest" in the new job! (if one plans on linking I-140 approved under NIW...

things to do after the job change for pending NIWers

ForXP/Raj97, Thanks!, another question: For NIW, I understand that one needs to be continue working in a "similar" field; how about EA? Does one still need to show "similarity" in the field??

things to do after the job change for pending NIWers

Hi Forxp, Just out of curiousity, are you still working in a similar area which can be categorized as "national interest"?

    I-140 and Change of Job?

Thanks eb1doc! If I understand you correctly, if I-140 gets approved under NIW, it is advisable to continue working in the national interest until I file (and receive approval of I-485). However, if I plan to "link" I-140 approved under the EA category, then I can change jobs as soon as I...

    I-140 and Change of Job?

Hello, I am planning to file I-140 only under EA and NIW category. My questions are: 1) If the petition is approved, do I have to work for the same employer for 6 months before I can switch employers or is this 6 month rule only applicable when I-485 is pending? 2) If the NIW petition...

after I-140 H1 can get 3 years of extension .

Hello, I think you can file for H-1B extension if your 1-140 was filed atleast 365 days prior to filing for extension, however, I dont think you can apply for a 3 year extension. I think it is extended for one year at a time but I am not completely sure.

    I-140 and EAD??

Shankyyy, As far as I know, you can only file for EAD with the I-485 application.

    Gap between I140 and I485?

I am planning to fill I-140 petition through the EA and NIW routes. My understanding is that 485, 131, and 765 can be filed simultaneously. However, if I only want to file I-140 now, how much time can I wait (after I 140 approval) before filing the other forms (485, 131, 765)? Thanks!
