Reading ur case i think u would have the captured the older PD. I am in the same boat. I have a EB2 I1485 (PD of 07/06) pending with TSC and a older EB3 I140 (pd of 12/04) just got approved. How do i get the older priority retained.

I dont think there should be an issue with this. One should be able to port a priority date from one category employment based immigrant petition to another one with an earlier priority date within the same category or different category so long as both of these petitions belong to EB1...
I think what your employer is trying to do is to refile the H1 with the new job requirement and then apply for the PERM. What he/she plans to do is entirely plausible. But trying to do it w/o that is risky. DOL can say that the employer is twisting the job requirement to suit the beneficiary.
She should be able to apply for PERM EB3 labor. As far as the preapproved labor is concerned it needs to be checked what are the education requirements and job title/skills mentioned in the labor.

I think ETA and BEC is too big to care for the same format of letters. Your letters should state the situation and express your employer's intent to pursue the case with a request to reopen and I think that should do it.

So what you really mean is that the question is not important ? Why would they ask such a question on the form I-140 if it was irrelevant and did not really matter ?? I am confused.
