Please can you share the advice of your attorney in your case? I am in the same situation as you but I have two more kids under 21 and my husband as qualifying relatives in my case, but the 21 years one is the main extremely hardship.
I don’t understand how they say no visa number available since last week they were approving in NY
Did you ask to expedite due to qualifying relative aging out? If so, when do they reach 21?

The annual cap for cancellation of removal is fixed at 4,000. Once those numbers are gone, they just stop issuing them until the next fiscal year starts.

I explained to my lawyer all the approvals we seeing this group, My lawyer forcing me to file i130.Because my daughter turn 21 last month and she need 15k for both.I spoke with court employee last week she told me visa number is not available this point.I don’t know how system works. My Final hearing was 5/2022 NY.
I know that, but if they are still granting then I don’t see how they can’t put this person ahead since that is what the motion is for. If they are still granting then I would think that means that there are still visas available. I don’t work these type of cases so I don’k know.

Yes . She turned 21 last month. Motion filed on Dec2025.
