M on L1 visa, just applied for GC through marriage to USC.

my question is can i quit my job, while the application is processing? what will be my status then?

can i travel upon quitting and will I be allowed back in? provided I get Advance Parole prior to leaving while application is processing?

thanks in advance.

Adjustment of status

Question for the group.

My girlfriend overstayed her tourist visa before we got married. She was here in February/2013 and we got married in November/2013.

Here' how I understand the petition process.. I will file form I-130 and I-485 for her and address it to the Chicago lockbox (I am a US citizen).

She has a daughter in the Philippines. Can you correct me if I am wrong with this process; I will file form I-130 seperately for her using a different lockbox i.e. consular processing. Can I petition for her on the I-130? How long should I expect the process to take?

Any response to this inquiry is appreciated...

Yes, once you have the I-485 receipt notice you can quit. There isn't an official name for the "status" you'll have, but you will be considered legally present while the I-485 is pending.

if i quit, and my AP isnt approved in time....will i still be allowed back in states? I am scheduled to travel on feb 8 for my cultural wedding....and come back on march 25th..and i have requested for expedited processing (on the basis of financial loss) but still yet to hear back....but just incase my AP doesnt come back in time what are my options?

If you don't have Advance Parole, you will need the valid L1 to reenter the US while the I-485 is pending. If you quit, that invalidates the L1.

You might still be able to reenter the US after you quit, because the employer might not notify USCIS right away. But later on once USCIS pieces all the facts together (such as the final review before approving your green card, or years later if/when you apply for citizenship), if they find out that your L1 was invalid when you used it to enter the US, they can deny your green card or revoke it.

can i enter back in under the visa waiver program as a visitor? (my country is part of the visa waiver program)

If you tried to reenter with the visa waiver, you will be refused entry if the immigration officer is aware that you have a pending I-485.

If the officer isn't aware of your I-485, and you're allowed to enter with the visa waiver, your I-485 would eventually be denied. While you have a pending I-485, you can only reenter with Advance Parole or H1B/H4/L1/L2; using anything else to reenter would result in cancellation of your I-485.
