DV lottery and marriage

Hi!
Greetings from Iran!
I'm currently unmarried and I enrolled my name for DV lottery 2015. Now, imagine that I'm selected for DV lottery 2015 and I go to the United States' embassy for an interview. Imagine further that I also pass the interview successfully and I'm finally granted the United States' green card and I'm still unmarried. Then, after living a few months in the United States, I come back to Iran and marry a girl. Can I bring her to the United States? What kind of qualifications must she have so that I can bring her to the United States? Does she need to be interviewed?

Yes. You can file a petition for her Green Card. She will not need any special qualifications, as long as she has not violated any laws in the past that bars her from entering the US.

However, in the past it has taken anywhere between 3 to 5 years to get the Green Card. People have reported that recently they got it in a little over 1 year. The problem is that in the meantime the lucky girl will not be able to travel to the states and you will have to live separately.

The safest and most efficient way to do it is to get married before your interview. Even after interview and before entering the US, you can still get married and schedule for her interview (it's called follow-to-join). But that's a bit risky.

But hey, DV-2015 has just started. It's not advisable to see DV as a "plan".

I hope this was helpful refigh! :)

Do you mean that it takes a little over 1 year for her to take her green card or for me?

You will get your Green Card almost immediately after entering the US. She will have to wait longer (best case scenario 1 year, worst case scenario 3-4 years). She cannot enter the US during this time.

What happens if I get married before my interview. Must both of us go for the interview? If yes, what happens if I who have enrolled for DV lottery 2015 to be accepted at the interview and my wife get rejected?

Now, a similar question: What happens if I a get married after my interview. When does she need to go for the interview? Now, what happens if I who enrolled for DV lottery 2015 to be accepted at the interview and my wife get rejected?

Your previous post was helpful "doste man". This word also means refigh

Almost certainly you will be interviewed at the same time.

Not very likely. If she doesn't have a criminal background, has not entered the US illegally in the past or has not overstayed her visa, you will not have anything to worry about.

I think you will have to re-do the interview this time with her. Same situation as above. If your marriage is bona fide (not fake) then you will be approved together. If the officer decides that your marriage is not bona fide chances are you will both get rejected. The safest route is to get married before the interview.

So, if I get married before the interview, isn't there any investigation about fake marriage at all?
To put my question in a nutshell, am I also rejected if my wife gets rejected for whatever reason?!

Yes there is an investigation, but there is probably one if you get married after you get your green card as well. Is this a green card marriage? My father married a citizen and they had to show evidence it was a genuine relationship. (Just to be clear, theirs was a genuine relationship, the point is don't just assume there will be no investigation just because you already have your green card.)

And I believe I have heard of cases where the principal applicant gets offered a visa while the spouse is rejected. But if it's a sham marriage, you'll both get rejected and banned permanently from entry into the US. And if you enter into a sham marriage afterwards and it's discovered they can revoke your green card.

Let me put it this way.

1) If you have a girlfriend, who you are not in a rush to get married to, but after you win the lottery you decide to get married so both of you could enjoy your new life in the US, YOU WILL BE OK! That's perfectly understandable and fine. Nothing to worry about. The "investigation" can be addressed by simply showing a few old photos to show that you knew each other from before. Or your wedding photos to show that you are a real couple.

2) If you win the lottery, and then a rich guy approaches you and says I will pay you $10K to get married to my daughter so she can go to the US, and you meet the girl for the first time at the gate of the US embassy, then you will be in trouble.

And finally, mashdi don't sweat it too much. When you win the lottery (1% chance), you will cross that bridge then.
