This site really helped me through the AOS processs and i hope somebody can just help think through this position am in right now.
I have been married to my USC wife since Oct. 2010 and it was through this i got my 2yrs green card. My 90days ROC window will open in late january. A lot have happened to our marriage since i got my green card. She had cheated and still cheating on me. I have caught her with a guy in our matrimonial home and in fact, she was pregnant for this same guy she is cheating with. We (in fact, I) have try to work it with no success.
Knowing that my ROC is coming and the fact that am still going to need her for the process, i traded softly with her and reluctant in getting a divorce. But i think it has gotten to a point where i feel saturated with the pains and hurt and the fact she is not showing any chance of change, so am ready to go for the divorce. Our marriage was based on love and not for the sake of green card. All her family including her father likes me and i have all the proofs to prove the genuity of my marriage. She actually agreed to assist in getting the condition lifted on my green card.
In order to go through this successfully and avoid making any costly mistakes, i have these following questions:
1) Does it matter if am the one that legally file for the divorce and file for I-751 waiver? As an evidence, i have the discharge paper when she was discharged from hospital after aborting the pregnancy she had with the guy, the police report when they both involved in a car accident, this happen in one of the times she was sleeping in this guy's house. I have the audio recordings of her confesssion about the pregnancy and all these couple with appartment lease, bills in both our names, car title and insurance, checking and credit account etc.
2) Do you think filing a no-fault divorce or at-fault divorce (if i file the divorce based on her adultery and she in fact said she dont have any problem with this) will have any effect on how long it will take the divorce to be final or on my ROC?
