application for spouse of citizen

We are trying to fill out the lottery application for my husband. I am a US citizen, he (obviously is not). We are living in Israel.

In the spouse question, there is no space to indicate citizenship status of spouse (me), and the derivative application comes up and is required to be filled in. (also no place to indicate citizenship status).

I saw in the instructions that children who are citizens need not be included, does the same apply for spouse? Or, do I need to fill in all info including photo as if for derivative applicant?

I don't think they thought of it when designing the form. A spouse of a US citizen is more likely expected to get their GC through their marriage status and not via DV lottery. Have you considered that route instead? I know they are yearly quotas but it's more for sure than going through the DV.

If you still want do go thrught DV I would suggest filling in your details in the derivatives part of the form and if your spouse is selected, then explain the details in the DS230 form on application. I think it sounds better than omitting you from the EDV form completely.

If he doesn't get the gc through the lottery we'll probably go that route, but since we live abroad I would have to move back to the US by myself to reestablish residency etc. for a minimum of 3 months, and we rather not get separated, especially since we have an 18 month old who needs to be with both parents....

As far as the DS230, I didn't see that in the online form, does it come up after the derivatives form?

Also, I saw there is a phone number to call the Kentucky center - I will call a bit later because of the time difference. Do you know if there are reps there who answer these questions?

Just an update for those looking for answers to this question as well.

I spoke with a rep from the Kentucky center and she explained that unfortunately the instructions contradict themselves so she has no clear answer... she suggested that I INCLUDE myself as a derivative just in case.

There should be a way for him to apply for GC without u having to come back to US first. My friend did it. Did you inquire at the local US embassy? It's not a gamble for you guys, but pretty much a sure thing since you're american. Just a matter of how long it will take. Either way, good luck!
