Hello Everyone,

I am a GC holder since 2009, I obtained my GC via the visa lottery. Am marrried but during the processing my wife and i were not living together (though not legaly seperated or divorced). I completed the processing and included her name as spouse and persons who may be travelling with me latter on the form. On my final interview date, the officer put SEP meaning seperated on my visa and that is what i have carried since 2009 to date. I have been in and out of the US since then, travelling usually within 6-10 months as I still work in Nigeria and have been waiting to have a better economic stability in the US before relocating finally. I have had a number of issues at the immigrations as per my stay outside the US but most times they dont even ask, I guess its cos I travel consistently at least once every yr.

My problem is, my wife and i have since reunited and she wants us to relocate to the US, I wish to file for her to get a GC as well as for my little 2yr old, what should i do? Ho do I do that, Can I file for her from Nigeria?, what are the chances? They denied her and my baby the last time they applied for a visiting visa...? They said their is no evidence that they would return.

Please help, I need guidance on what to do....?

I wish you more success in the immigration process than your Super Eagles have been enjoying lol! Anyway you can only file for her from the US. As a green card holder you are supposed to make the USA your domicile. With your frequent travels outside the country, you are putting in jeopardy your own green card, without which you cannot even file for your child and wife.

In any case, filing for your wife will take a VERY long time since you are not a citizen. Indeed I would encourage you to spend the required 3 additional years here to become a citizen so it expedites their process. So in short, yes you can file for them here as green card holder. Once you become a citizen, you can amend your petition to reflect you have become a citizen so it expedites their process.

They will never get a visitors visa at this point since they already showed immigrant intent by the original green card petition so don't even bother to apply for visitors visa.

How much time (total in months) have you spent in the US since obtaining your green card? Do you have a reentry permit?
