Hello, everybody!
I am getting my paperwork together for the green card interview which is scheduled for September 20th, 2011.
I have been able to secure a job and would like to use my income to supplement my husband's income. But I don't know which form I-864 to fill out in addition to what we have already sent. Any input will be greatly appreciated.

The Form I-864, Affidavit of Support

The Form I-864, Affidavit of Support, is legally required to be filed by the petitioner/sponsor for all family-based petitions, including immediate relatives, and some employment-based immigrants, to show the intending immigrant will have adequate means of support and are unlikely to become a public charge once they have immigrated to the US.
 
It is the same form I-864. Fill out a new one adding your income in the area provided and take it along to the interview. If however your husband already met the minimum guidelines, there is no need for the update.

Thanks, Ananga. I will fill a new one out and take it with me on Tuesday.


It is the same form I-864. Fill out a new one adding your income in the area provided and take it along to the interview. If however your husband already met the minimum guidelines, there is no need for the update.

Do you know the waiting period to apply next I-864 AOS?

Hi,

I have applied family based GC (CP process) for my mom and she got her Visa on Last month. She did not enter in USA yet. She is planning to enter USA around at the end of December, 2011. I checked my income level I can give support to another 3 persons. My wife applied for her mom for same GC visa. Her I130 is approved. Her income is not sufficient to submit AOS for her mother. She is asking me to provide her supporting AOS as well. I have few questions here:

1. How long I have to wait till I shall be eligible again to submit AOS for my mother-in-law?
2. Do I need to wait till my mom gets entry to US and get her GC on hand prior to apply for my Mother-in-law?
3. I was only one who provided AOS for my mom. For my mother-in-law, I shall be a secondary AOS applicant. Is there any special things that I need to follow?

Please advice as early as possible.

1 and 2: No waiting to file I-130 for your MIL. When the time comes to file the Affidavit of Support for her, you can file it if you have the income level required for your household size (which would include your own mother.)

Since you would qualify as a "household member" of the petitioner (your wife), you would file I-864A, not I-864.

Many thanks for your reply. Just to understand you clearly, I gave more in detail on the issue. Here is what I need help:

In Form I-864, section 9 it says:
"I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2 above. Do not include any relative listed on a separate visa petition."

I filled up this only for my mother at the time she was applying in May, 2011. Now, I have to do this similar Form- I-864A, for my mother in law which is less than six months. Will it be a problem?

No, even if your MIL was immigrating within 6 months of your mother's immigration, you were not supposed to list her on the I-864 for your mother, because the instruction says "Do not include any relative listed on a separate visa petition." That question is asking you to list family members who would immigrate as derivatives (spouse and/or children of the primary immigrant) pursuant to the same petition; your MIL will immigrate on a separate petition.

Your wife must file I-864, and you would file I-864A, and you do not have to wait to file it (other than the usual waiting already built into the process).
