I would like to start a new thread about the adjustment of status for winners of the DV-2012. I think there's plenty of information in the threads for the earlier years, but some things might have changed. I don't find the Department of State website very clear as to what the next steps are, and while I'll be calling the KCC on Monday, maybe in this thread people can help each other and discuss how to proceed in their various situations.

A couple of questions from my end to start out with. Here's my situation: I'm a German citizen, but I am currently in the US on an R-1. My case number is 000061**, so I think I'll be able to do an AOS. The DOS website isn't very clear as to what's next though. I know I have to pay them a fee, but I see in other threads people had to submit some forms to the DOS too - it doesn't say anything about that on the website. What is my first step?
Do I pay fees and submit forms to the KCC first? Which ones?
How and when do I get in contact with the USCIS to have them process my case?


Sorry, but I wasn't able to find this information clearly enough elsewhere. As I said, I'll be calling the KCC and USCIS on Monday to ask them the same questions, but maybe someone here has some answers?

I myself was also selected for further processing for the DV 2012 lottery (Case Number 2012AF0004XXXX).
I'm a Libyan citizen here in the US on an F-1 Visa. I was confused as to how to proceed. I called the KCC and they advised me to send in my DSP-122 with 2 photo ID's and the barcode, they also advised me to call the USCIS. The operator at the KCC also told me the numbers for 2012 haven't been announced yet.

So I called the USCIS and very briefly explained my situation when the operator simply told me "you are eligible to apply" without hearing much info about my case except for the fact that I was here on an F-1 Visa. I felt as if she was reading off a screen and didn't sound like she knew what I was asking... I wasn't very reassured by that so I set up an appointment with the local USCIS (Infopass) here in Chicago for next Monday to clarify with them whether or not I was eligible and if I could send in my I-485 with accompanying documents for AOS.

Any suggestions or insight would be greatly appreciated... Thanks in advance ;)
 
hmmmm.... i've been reading some forums even though there are not much now for dv 2012.....
in the notification letter that we see when check our status, it says at the very bottom we need to send dsp 122 and 230 to KCC.

then when I read instructions at their link, there is "Diversity visa selectee already in the United States " link at the very bottom of that page and it says "When the principal (primary) diversity visa selectee is already physically present in the U.S., you may be eligible to apply to the U.S. Citizenship and Immigration Services for adjustment of status. Click Adjust Status to learn more". so i click on adjust status and a new USCIS page opens up. how do I make sure i m eligible or not? does it mean once i m eligible i only need to file I 485 for AOS but not the DSP 122 and DS 230? or does it mean I have wait till my case number is current viaa visa bulletin and then file I 485? i m very confused??

Yes, I basically asked in some other threads and called the KCC today. You need to send in:
1. Form DSP-122
2. Two passport photos
3. The selection letter with the barcode.

You do NOT need to send in the form DS-230 if you're doing the adjustment of status.

Then you have to pay the DV fee of $440, wait for your case number to be current and send in the I-485 with all supporting documents to the USCIS. In any case, this will not be before October 1, 2011, so don't send it before then.

so should I send the dsp 122, two photos and the letter ASAP? or should I wait till october 1st?

do I pay the fee 440$ right now or later

do I send anything for my spouse?

Yes, that's right. Send the stuff to the KCC now, then wait for your number to be current to file the I-485 to the USCIS.

I actually don't know exactly when to pay the fee, but you have to do it before you file the I-485 because you need to include the payment confirmation from the DoS in the package you send to the USCIS.

i asked my immigration lawyer (who did my husbands H1B process this season), and he said that if we are in the USA then we only fill and send the I 485 aos form when the case number is available. i asked clearly that if we need to send dps 122 and they said no. so i m still confused.....
 
That's not true. I called the KCC today, and they said they definitely need the DSP-122, along with two photos and the barcode letter. That way they know they can forward the case to the USCIS. But in any case, even if your lawyer was right (which I don't think he is), it definitely won't hurt to send those things in. So just go ahead and do it.

By the way, to answer your earlier question, only the principal applicant needs to complete DSP-122, but both of you need to pay the DV fee.

I'm in between what the attorney said and what people are writing in the forums. I had one friend here who got selected for DV2011 and worked with the same attorney and they did the same procedure - nothing sent to KCC, only AOS 485 form when the visa was available. His number was EU00003, very very low, but he still didint get his GC, he is expecting it some time this month. I though you'd get your GC with such a low number way before than this month...???Can it be because they didnt send any forms to KCC.??

I've read at least the half of DV2011 AOS forum, and there were people arguing this: some wrote if you are in the USA and doing AOS then you only deal with USCIS - nothing with KCC - no forms nothing..... others said, when they called KCC they were told to send DSP 122 and etc.....
one place, I read that even though you do not need to send anything to KCC, it's for your good to send and let them know about your intention for an AOS, so KCC can transfer your file to USCIS, and if you do so, then your procedure will not delay.... if you dont do so, then there may be some delays in your process.....

I have another question, my case number is EU301xx, accroding to 2011 this number is now current, lets assume for my case it will be available in july 2012, so thats when I need to file 485 AOS. will I have enough time before september 30 2012, for an answer or for my green card? or will there be no enough time and they will deny it or what? how does it work??

Well, I don't know what to tell you. I'm not sure about your friend's case. All I know is I called the KCC, and they told me to send the DSP-122, two photos and the barcode letter. Tons of people here did the same thing and got their green card that way. So that's what I did too.

I don't really know if your case number is high or low ... I suggest reading the "2011 AOS Only" and the "2010 AOS Only" threads to see if you can find an answer there... Sorry!

if i were you, i would copy the same thinkg in ur questions #15 and post it in (2011 AOS Only) there are some experianced people still there and im sure they could give you better and more accuret answer .

how about the spouse
is there anything that should be sent to KCC
