Need advice, K-1 OR K-3 visa? Please help?

The attorney is wrong!!!
You just need to have proof that you have physically met each other WITHIN the past 2 years (ie, a boarding pass/passport stamps etc). It could have been yesterday, it could have been 1 year and 364 days ago....just so long as your last meeting was less than 2 years ago.

As long as you are both free to marry (which it seems you are as you both have finalized divorces) then you can petition a K1 visa for your fiance (be sure to include a copy of both your divorce decrees in your petition.
During the time that your paperwork is in process, collect/gather documentation that proves you have a bonefide relationship (ie copies of all boarding passes/passport stamps to show you have visited one another, photos together, itemized phone bills, emails, letters/cards sent to one another etc).
