:confused: Hi All

I one of my previous post I asked for your advise regarding naturalization. I'm aware that I could apply for my naturalization 3 years after being married to my USC hubby. I could've applied 8/10 but we divorce on 9/10. Can I still apply for my naturalization now(since my divorce came after my 3 years timeline), or wait until I have 5 years with my gc?

No, you may no longer use the 3 year rule when filing N-400. You have to use the 5 year rule now, and the earliest you may file is 90 days prior to the 5th year anniversary of your LPR status.
 
You cannot apply based on your marriage to a US citizen as while applying for citizenship, you need to be living with that citizen spouse if you are applying based on the 3 year rule. You can wait till the 5 year term ends. You can start applying 90 days before the 5 year term ends.
