Need Help Desperately!

Is he an overstay or an illegal entrant? An illegal because of an overstay is forgiven by marriage to a USC. AN illegal entrant (EWI) cannot be made legal while he is in the US and a quick legalization is not possible without qualifying for a waiver.

Hi all,
I am a US citizen and my husband is here illegally, what can I do to make him legal?

As the other member answered that's right. If your husband had overstayed & became illigal that's simple. You being an US citizen can adjust his status easily but if his entry is not legal it's complicated.
I just filed for my wife ( legal entry but overstayed ) & all it took us only 4 months & wife's GC already been approved also card has been mailed too. It will take just a matter of time to be in our mail box.
So as you can see what I meant. Overstay is forgiven to USCIS if married to an US citizen but entry has to be legal.
Atique.

He entered the US illegally 10 years ago.

Too bad. There is almost no hope if his entry was illegal, unless he had filed the appropriate paperwork before the April 2001 deadline to qualify for 245i.
