Confused: N400 eligibility

Dear All,

I am a PR from 10/06/2005, i calculated that i am eligible for citizenship from 07/09/10 as that date was 89 days before (according to wolfram alpha), then i sent my application today so that USCISreceives it on 07/09/10.

When i manually calculated 07/09/10 is right on the 90th day. Thus USCIS will receive my app on the 90th day prior to my PR day. My question is is this OK, that the application is received on the 90th day before 5th year of PR anniversary.

When does USCIS calculate the 90 day rule, i.e. from the time they received the application or from the Priority date generated?

July and August have 31 days each. Redo your Math. You will see that you are well within the 90-day limit on your 5th year of GC to qualify for N-400 filing. Shed worries. Look forward to the process.

When does USCIS calculate the 90 day rule, i.e. from the time they received the application or from the Priority date generated?

They are supposed to look at the received date. But they have some inexperienced low-level employees who do the initial opening of the mail, and sometimes they look at the postmark date, or the signature date. Or sometimes they correctly look at the received date but they miscount by 1 or 2 days.

So even if you are rightfully within the 90-day window, when you are exactly on the 90th or 89th day you expose yourself to being rejected before the interview because of their mistake. That is why it is recommended that you wait for day 85 or later to sign and send it, in order protect yourself from their mistakes.
