As an f1 student, i wasn't allowed to work outside of campus, which i actually did for almost 4 years by now. i got married to my fiancee that i dated well over 2 years applied for a GC and my lawyer said i should put my w2 forms in the envelopes for affidavit of support. now my question is; i pay my taxes on time, i have a good job, i have a very clean record on everything and instead of lying to a federal department despite the fact that i know irs-dhs doesn't share information, i still wanted to be honest to a federal institution as a good, moral human being, who works hard, pays his taxes, and supports the US Government. Do you think USCIS can hold me responsible for my illegal act of work over years?

Thank You for your answers guys, sharing information means a lot in this age!

Of course they can. Your marriage to a US citizen generally results in "forgiveness" for your illegal work.

Given that you knowingly violated US laws by your illegal work, I disagree with your statement that you are a "good moral citizen"; someone with morals and of good character would not have deliberately violated the laws of the country in which they had been granted the priviledge of studying. It should certainly make your spouse question whether the marriage was for an immigration benefit since your illegal work would not be forgiven in other circumstances. And, if you worked for 4 years, why have you paid taxes for only 3?

well , there are almost 10 to 20 million illegal immigrants in US and saying that none of them has a good moral character because they work would be such a disregardin and uneducated statement to make, and our federal officers are very experienced and discretional about these subjects which i trust very much, and simply have no worries about it. If they really wantes to enforce it, you know they could,Thank you for your response tho

Anyone who enters any country in violation of that country's law is by definition a criminal. It is even worse when an educated individual (such as you should be if you were actually qualified to attend college) violates the law as you have done because it is not a matter of life or death just a matter of money.

The federal officials are directed by laws governing your situation to overlook you illegal acts based on your filing status. That does not make you an individual of good character; your illegal actions were deliberate and done knowing you would be in violation of US laws. They may forgive you, but I do not find you trustworthy. Did your employer know you were working illegally - or did you lie to him? I feel sorry for your spouse because your forgiveness is only because of your marriage. Is the marriage true or for an immigration benefit? Only you know for sure, but I will assume the worst based on your demonstrated character.

Well my employer is my uncle, my wife is my high school sweetheart and my character is not up to your application of law 101 , as all professional government workers know, including people in my family, who works for PD, application of law is a lot different in reality than what you read in the books. Your social interactions with your society lets you you use discretion more,and we are not mindless robocops . You cant call me a criminal because i violated my visa status, i still didn't commit any illegal activity in US, what was given to me was taken back,it is just a violation. if you are a reasonable person who went at least to high school and graduated, you wouldn't call me a criminal because i violated my I-20 instructions rules? It is same thing as calling illegal people criminals? I know very good, helpful, educated, undocumented friends who helps their communities, and very good people in heart, they work hard to send their kids to school. Your definition of criminal is a lot different then what we know here and i feel obliged to teach you what a criminal is;

1. Of, involving, or having the nature of crime: criminal abuse.
2. Relating to the administration of penal law.
3.-a. Guilty of crime.
b. Characteristic of a criminal.
4. Shameful; disgraceful:

i did not commit any of these things but i violated the privileges that was given to me.
What you are saying here is unconstitutional and not American. There are different opinions on Immigration but all of our grandfathers came from somewhere else, and loved America. This country Unites under one flag, from a lot of different races and ethnic groups in all different government levels. Before you say anything about immigration and call undocumented people criminals, please think twice.

Best Regards

Just a PS; Unless i convicted in trial and found guilty, in this case i am presumed innocent unless proven guilty, and there will be no trial after my application. It is like an off duty cop killing 2 robbers to defend innocent civilians and he will be forgiven from his 1st Degree Muuder for his actions before he can be trialed.
