Can former J-2 visa holder obtain DV visa?

Hello everyone,

My situation is: A few week ago, I've recieved DV 2011 notification letter.

We, my husband and I, are former J-1 and J-2 visa holders, who returned to the home country last year, June.

My husband's J-1 had 2 year HHR. So it will be finish by June of next year, 2011.

My questions:
1/ Can we obtain DV visa?
2/ Am I also applicable to the HHR?
3/ How will be the 2-year calculated in order to decide whether the applicant is eligible to DV visa?

Please help us to know more about the process.

Congratulations...
Just on the surface of it you should be ok since by next year June (still within the DV year 2011) you should have satisfied the 2 yr residency requirements. If you have a low enough CN it probably would be smart to delay your interview to coincide with the end of the residency time period (June 2011). What region are you from and what is your CN? From this info you can judge by looking at past years' visa bulletin when you are likely to be interviewed.

My CN is 2011AS00010XXX and from Asia. I don't know how to look at visa bulletin and know the period. Tell me, please. Is it possible to delay the interview? And How?

Hi,

The visa bulletin for 2011 winners starts from October 2010, which is the beginning of the 2011 fiscal year.

The first numbers for 2011 would be available from the August bulletin, which will give both September and October numbers - check it out on this site http://travel.state.gov/visa/bulletin/bulletin_1360.html

Within this bulletin, check numbers provided against the region, so for AS, you will be current in the month the published number is higher than your CN. I don't track the AS numbers, but from what I've read you're unlikely to be current until sometime in 2011. For example, in February 2010, the cut-off for Asia was 10,550.

1. Technically, Yes, if your 2 year rule ends by Sep 30 2011.
2. J2 should be subject to 2 year rule. Look at your passport and see what your J2 visa stamp says? Can you find "......is subject to section 212........" or " ....is not subject to section......"? Which one?
3. DV visa could be issued between June 2011 and Sep 30, 2011. I am not sure if KCC consider of this (maybe NOT) when KCC determines the date of your interview. I am also not sure how the embassy/consulate takes care of it.
