i am married but i applied as a single ( it was misunderstand )
Now i am in USA with my wife ( we expect baby next october ) and i am DV2011 winner.
What should i do
i am thinking about send DSP122 and DS230 to KCC to update my status but i am afraid i will be disqualified
or i will send just DSP122 and file to AOS and if they ask for my marriage certificate on the interview
i will give them mine and i think they don't care about the time when i got married

I would be very much grateful for any feedback.

thanks.

my friend you make a very very big mistake, I read a story for a guy here in this fourm he applay single also and he is married, in the day of the interview they reject his visa because of this mistake, I advise you don't continue your procedures because you will lose money for nothing, it's hard but true, wish you good luck

If your marriage certificate is dated before Oct/Nov 2009, then you have a serious problem. You need to seek legal advice. Where did your marriage took place, in US or back home in your country?

I got married in my country

So sorry, but if you were married and didn't include your wife. you will no longer qualified, don't waste your time and money. hope you can win next year.

Maybe you can continue the process on your own. If you are sucessful you can apply for your wife and child to come join you. According to the USCIS website

Green Card Through Family

If Your Family Member is a Permanent Resident

You may be able to get a green card as a family member in a preference category if your family member filed a Form I-130 on your behalf.
Family member of a permanent resident in a preference category
You are a family member of a permanent resident in a preference category if you are:

The spouse of a permanent resident
The child (unmarried and under 21 years old) of permanent resident
The unmarried son or daughter (21 years or older) of a permanent resident

Thanks invest

Maybe your friend was doing CP. I am doing AOS.
Are they the same or there is difference

how about if i continoue and do AOS for me only and in the next forms i will write i am married ( in i485 and other forms they don't ask for marriage date )
will they ask me to show them my marriage certificate?
i think they don't need it

mohkha once there is a discrepancy in your information they will more than likely ask for proof that is the marriage certificate. My only advice to you is if you can afford the risk of losing the processing fees then go ahead with the process and try to explain that it really was an honest mistake and you were not trying to trick them or anything like that. After all you would have your documents to prove that you were indeed married when you applied.
This is an unfortunate situation but if I had the money and could afford to lose it I would try my luck. Good Luck to you...

What you can do is telling them a lie that you were single at the time of entry, your document also should be the same, if they found out your lie then you will be banned to enter in the State most likely in the future. if you claim you were married and you didn't include your spouse to the electronic entry form, you will be disqualified (read the link bellow, and the sentences in bold that i took it from that. now it's your decison to go head and lose some mony or give up at this stage.

15. SPOUSE INFORMATION – Name, Date of Birth, Gender, City/Town of Birth, Country of Birth, and Photograph. Failure to list your spouse will result in disqualification of the principal applicant and refusal of all visas in the case at the time of the visa interview.

thanks for your advice i will give up

Don't give up yet, find out if it is possible to do another marriage certificate in your country (just try to be a smart guy and make sure your marriage certificate shows a date after you submitted your online dv application).

Naaah!!.....it wont work. He is here with his wife. I blv they are on H or F.
That means the system already has their info as a married cpl UNLESS wife came on her own visa than a spouse visa. (or vice versa)
All will come down to what info about them the system already has.
DO NOT take adhoc decisions and jeopardize the current status as well.
Talk to a lawyer, that's the best you can do now. KCC cannot do anything.

Best !
