Hello,

I am struggling to see if I am eligible to get citizenship? I am very special case!

I have been in the US from April 2006 (paying taxes in the US, working here, no bad record, register for selective service)

However, I got my GC in 2000 through my mom. I have been travelling every year since 2000. Last time I travelled before I settled in the US is June 2005. After 10 months from then I came and settled in the US (April 2006).

If I count from June 2006 till now, I am not eligible now. (Eligible in 2011)

But if I count from July 2005, I am eligible now. Will that 10month gap outside the country affect my eligibility now. Can I explain that since I was studying in India I could not be here and apply now?

Please advice.

Thanks.

my case is kinda like urs, i got my GC through my dad in 2003 and i was in college, had been in america for a month then returned to india came for 2 months to america in 2004 took a re- entry permit and left the country and later entered america IN 2006, feb. fortunately for me I could apply based on the 4 year +1 day rule. check to see if u would be eligible through that (catch : u cant apply 3 months in advance of 4 year and 1 day)

(Assuming you established residence in 2000) You can apply 4 years +1 day after you returned from that 10 month trip.
