About my I-589...

I came in us a few months ago with my 3 children on a b2 visa.I was also pregnant. I hired a lawyer to fill for asylum just for me and my daughter ( my other children are us citizen). I have a few question regarding my application because I cannot find anything similar to my case.

I belong to an ethnic group who continues to perfom female genital mutilations and my daughter and I have been persecuted by abusive husband and in laws.Ive tried everything but the only way to escape for me was to run away with all my children. Regarding my case I dont have much evidence unless my scars and my native country's cultures and laws.

Here are my questions:

1.Are witnesses allowed as evidence? if yes does he have to be physically present at the interview?
2.Does it help or not to have some of my children that are us citizen? should I mention them on the I 589?
3.What about my unborn?
4.What about being a single mother with no income? (since I m not allowed to work I support my children by sending goods to sell in cop)
5.What will happen to my children if my application is denied? (my status is still valid)

This is very serious and I really need help to not make mistakes again. Since I signed the retainer agrement my lawyer dosent help that much and seems to be too busy for me..

If my opinions are not your conclusions, here are some:

1) Not at the Immigration Office. But if you are referred to the IJ, perhaps a YES.

2) It may not help. But you MUST include each of your children on the I-589.

3)What about it?

4) I didnt get the question.

5) I am at no position to answer.

BTW, i think its critical to have the kind of lawyer who actually has time.

3) Do I have to apply olso for my unborn child? He might be born after filling and before the interview.
By question 4) I mint that I dont know if I will be asked about how do I support my children in US. Im strugglin right now because I cant work but I hope that things will be better once I got granted for asylum.(I pray every day)

I think my lawyer is more concern about money(what is obvious) and that makes me sad. I didnt know about free or low rates lawers. I didnt even knew that I can apply without a lawyer.But I know that its better to have one.
wish I had discover this forum sooner.

3) You dont have to list the child that has not yet born. With their birth on this land, they are a BORN US CITIZEN.

4) I recently underwent the asylum interview myself. The Interviewing Officer did not ask me that question. Actually i think a lot of them wont ask you such question. But its always advisable that you have a good answer handy.

I did not hire a lawyer while i filed mine. I did my interview sometimes last week, and am waiting for the results now. Yes, hoping for the best. Praying!!! As i firmly believe it counts.
You are at benefit if you have a lawyer than filing as a layman. Its just that the law DOES NOT require you to have one. Good Luck, i'm sure you'll be fine.

I had a similar case, where the evidence was the culture and social attitudes.

1. While witnesses are not allowed in the interview, you can easily find expert opinions on this matter as it is one being fought by many folks in this country. One of them being Hillary Clinton. If you need help doing research I'll be more than happy to help orient you. If your case gets to the courts, I imagine that the expert on the matter can testify on your behalf or submit a legally binding statement that the court will accept.

2. You have to mention ALL of your children in Section A part II regardless of age, status, etc. If you are legally married you must mention your husband. You do not have to petition him in your application, but must mention him. You will also include your children not born in the U.S.

3. Your unborn child does not need to be included.

4. You can only speak of how you support yourself. Be honest.

5. It is very unlikely that your application will be denied. If I were you, I would focus on gathering as much information to support your claim for now. One step at the time.

I really need to heard that (5.)you know. Im applying this week actually and my lawyer did collect some info about my case. I know how important it is also to follow carefully my case with the lawyer.And I will gather as much info as I can on the subject.My status is still valid so I think that I wont be reffered to court. I'll be very glad to be oriented by you however when the need will come.
