Initial Evaluation for EB2(NIW) or EB-1 OR

I will sincerely appreciate if you could provide your suggestions on the following credentials for a potential EB-2 NIW or EB-1 OR application.

Degree: PhD in Pharmacology
Speciality: Cancer cell proliferation

Fellowship Training Speciality: Angiogenesis

Current Position: Research Scientist
Current Employer: Medical School (Mid-West)

Number of Peer Reviewed Manuscripts: 7 (Impact Factor 2 to 11)
Number of independent citations: 40-45 (Google Scholar)
One figure has been included as "Image of the Month"
One paper (1st author) has been designated as "Highly accessed manuscript"

Number of Peer Reviewed Conference Proceedings: 12-15

Oral Presentations: 2

Book Chapters: 2

Grants: 1 from private foundation (during fellowship)
1 from state funding agency (during fellowship)
1 from state funding agency (during graduate school)
Amount: $110,000

Membership in Professional Organizations:
1. Nominated: AACR
1. Elected: Sigma Xi
2. Payed: (a) Developmental Biology and (b) Vascular Biology Organization
1. Sponsored : ASPET (Under Process)

Journal Reviewer: 5 International Journals

Although, both EB-2 (NIW) and EB-1 (OR) are evaluated on case-by-case basis there would be certain common traits of potential applications. Please provide your critique for the above case.

In my opinion, you can pass both NIW and EB1-OR. For the former, you can use your review experience, authorship, contribution to the field (citations + letters) and employer sponsorship.

Are you from a retrogressed country? If not NIW is relatively easier to wing than EB1-OR.

You have OK OK chance for EB1-OR. You will have to prepare your application properly.

Number of Peer Reviewed Manuscripts: 7 (Impact Factor 2 to 11)

7 - is OK number (Not too good but not too bad). I have seen cases, where people had same number of publication and got approval

Number of independent citations: 40-45 (Google Scholar)

Citations are good. Google scholar does not pick up all the citation. check for isiknowledge and scopus also.


One figure has been included as "Image of the Month"

This is like side item. Good to submit.

One paper (1st author) has been designated as "Highly accessed manuscript"

This is good but has no value. You can still submit against the importance of work

This is GOOD number.

Remember that for EB1-OR you need that your current employer sponsor you. In this the case? If not, you should try EB1-EA. In that case you need to fulfill 3 instead of 2 requirements of the 10-item list. It's also important how the evidence is presented: you need to draft a good cover letter to improve your chances and avoid RFE.

I appreciate all of the responses. Gives me a fair idea about by application from "another" perspective.

I was initially a post doc in the same department. For technical purposes, the department has reclassified my position as "Research Scientist".

Our school lawyer has adviced me not to go ahead with EB-1 OR at this time because I have not completed 3 years of research experience and also with limited publication-citation count. The lawyers have instead advised on EB-2-NIW.

So right now I am weighing all options, keeping my fingers crossed, and probably trying to start collecting evidences.

Any more comments and suggestions will be appreciated.

The experience part may not accurately reflect the requirement listed in the EB1-OR or EB1-EA criteria. You may be able to use your graduate research experience as part of the three year count.

NIW would be a waste of time and effort, especially for your case (with retrogression) where EB1-OR is an easy route.
