A question about petitioning for my wife PLEASE HELPP!

I'm planning on applying for asylum and wanted to know what happens if I (hopefully!) get approved and then marry my fiance? would that be more complicated than to marry her just before i apply for asylum? She stayed past her visa date and now is illegal, as am I.

We have a daughter together and havent been able to marry because of the money and our status.
 
Marriage after approval will not get her status until you become USC. Deportation.

But getting married just before applying may raise questions as to the authenticity of your claims especially if your fiancee overstayed her visa.
 
so what if we get married before i apply? we have been together for 4 years now and havent been able to marry for the reasons stated before, we have a daughter together and im about to apply for assylum and i dont want it to seem weird that i married her just before i applied, what do you think?
 
and how long can that take? i know is different for everybody, but im new to the process and after reading so many different experiences im left to wonder...

I have no valid photo I'd to get married because I lost my passport, ( I will get my I-94 but i lost My pasaport) we have a daughter together and she also stayed past her visa... Why will your marriage raise questions? its not like she is a USC and you will gain benefit. Your marriage is legit, get it registered. You even have a daugther together..so you guys are tied no matter what. Add her to your application rather than after. You guys are a family now right?So whatever happens will happen together..the last thing you want to do is, get approved and then they get deported.

absolutely agree.get married efore applying asylum then include your family in ur application.there is no question of raising doubt on this.
 
Thanks guys! you give me so much hope i can do this! im trying to find a lawyer that is more familiar with my situation, because my current lawyer is not so up to date. He is my friend and wants to help but im trying to find someone perhaps from my country or that is more able to help me with my case.
